Substitute Trustee’s Notice of Foreclosure Sale

SUBSTITUTE TRUSTEE’S NOTICE OF FORECLOSURE SALE 

Default having been made in the terms, conditions, and payments provided in a certain Deed of Trust dated OCTOBER 13, 2011 executed by JAMES P DUNN JR. AND THELMA M. DUNN, HUSBAND AND WIFE, to FMLS, INC., Trustee, of record in RECORD BOOK 1530, PAGE 394, in the Register’s Office for TIPTON County, Tennessee and to J. PHILLIP JONES AND/OR JESSICA D. BINKLEY, either of whom may act, appointed as Substitute Trustee in an instrument of record in the Register’s Office for TIPTON County, Tennessee, to secure the indebtedness described, the entire indebtedness having been declared due and payable by REGIONS BANK, being the present owner/holder or authorized agent, designee or servicer of the holder/owner of said indebtedness, has requested foreclosure proceedings to be instituted; and as provided in said Deed of Trust, J. PHILLIP JONES/ JESSICA D. BINKLEY, will by virtue of the power and authority vested in  me as  Substitute  Trustee, on WEDNESDAY, APRIL 9, 2025 AT 12:00 P.M. (NOON),  LOCAL TIME AT THE NORTH DOOR OF THE TIPTON COUNTY COURTHOUSE IN COVINGTON, TIPTON COUNTY, TENNESSEE, sell to the highest bidder for cash, free from the equity of redemption, homestead, and dower, and all other exemptions which are expressly waived, and subject to any unpaid taxes, if any, the following described property in TIPTON County, Tennessee, to wit:

PROPERTY LOCATED IN THE COUNTY OF TIPTON, TENNESSEE:

Lying in the sixth civil district of tipton county, tennessee, more particularly described as follows:

Description of lot 56 of Twin Lakes Subdivision – Section B as recorded at Plat Cabinet A Slide 195 in the Tipton County Register’s office.  Lot 56 being located on the east side of Bomar Lake Cove and situated in the 6th civil district of Tipton County, Tennessee. 

Beginning at a found I.P. in the east R.O.W. line of Bomar Lake Cove, being 50 feet east of the radius point of the cul-de-sac and being the southernmost corner of lot 56 and the northernmost northwest corner of lot 55 of Twin Lakes Subdivision – Section B, Plat Cabinet A – Slide 195; thence along the east R.O.W. line of Bomar Lake Cove, the northeast side of the cul-de-sac, with a curve to the left, having a radius of 50.00 feet, Delta angle of 63 deg. 16 minutes 59 seconds, tangent length of 30.81 feet, chord length of 52.46 feet with a bearing of N. 53 deg. 44 minutes 18 seconds W, a distance of measured along it’s arc  length of 55.23 feet to a point of reverse curvature in the east R.O.W. line of Bomar Lake Cove; thence continuing along the east R.O.W. line of Bomar Lake Cove, with a curve to the right, having a radius of 25.00 feet, Delta angle of 48 deg. 11 minutes 21 seconds, tangent length of 11.18 feet, chord length of 20.14 feet with a bearing of N 61 deg. 17 minutes 25 seconds W. A distance as measured along its arc length of 21.03 feet to a point of tangency in the east R.O.W. line of Bomar Lake Cove, being 25 feet east of the centerline; thence northwestwardly and continuing along the east R.O.W. line of Bomar Lake Cove, N 37 deg. 11 minutes 31 seconds W a distance of 164.65 Feet to a point of curvature in the east R.O.W. line of Bomar Lake Cove; thence along the transition of the east R.O.W. line of Bomar Lake Cove to the east R.O.W. line of Bomar Street, with a curve to the right, having radius of 25.00 feet, delta angle of 74 deg. 40 minutes 32 seconds, tangent length of 18.39 feet, chord length of 29.63 feet with a bearing of N 00 deg. 51 minutes 31 seconds W. A distance as measured along its arc length of 31.71 feet to a point of reverse curvature in the east R.O.W. line of Bomar Street being 25 feet to the centerline; thence along the east R.O.W. Line of Bomar street, with a curve to the left, having a radius of 207.00 feet delta angle of 06 deg. 19 minutes 55 seconds.  Tangent length of 11.45 feet, chord length of 22.86 (Erroneously 22.&6 In deed of trust) feet with a bearing of n 38 deg. 39 minutes 54 seconds e, a distance as measured along its arc length 22.88 feet to a point of tangency in the east R.O.W. line of Bomar Street;  thence northeastwardly and continuing along the east R.O.W. line of Bomar Street, N 35 deg. 29 minutes 04 seconds e, a distance of 130.37 feet to the northernmost corner of lot 56 and the northwest corner of lot 35; thence southeastwardly along the northeast line of lot 56 and the southwest line of lot 56, s 54 deg. 50 minutes 56 seconds e, a distance of 150.76 feet to a exterior corner of Lot 56 and exterior corner of Lot 35 being in a west shore line of Bomar Lake; thence southwestwardly along the east line of Lot 56 and a west shore line of Bomar Lake S 06 deg. 25 minutes 44 seconds W. A distance of 56.59 feet to an angle point in  the east line of Lot 56; thence southeastwardly and continuing along the east line of lot 56 and a west shore line of Bomar lake, S 36 deg. 02 minutes 50  seconds E, a distance of 92.29 Feet to a angle point in the east line of Lot 56; thence southeastwardly and continuing along the east line of Lot 56 and a west shore line of Bomar lake, S 05 deg. 40 minutes 56 seconds E. A distance of 64.20 feet to the easternmost southeast corner of Lot 56 and the northernmost corner of Lot 55; thence southwestwardly along the southeast line of lot 56 and the northwest line of lot 55, s 67 deg. 54 minutes 07 seconds w, a distance of 115.35 feet to the point of beginning and containing 1.17 acres more or less.

Subject to restrictions, reservations, easements, covenants, oil, gas or mineral rights of record, if any.  

Being the same property conveyed to James P. Dunn, Jr. and wife, Thelma M. Dunn by warranty deed dated January 17, 1987 of record in Record Book 574, page 69, Register’s Office for Tipton County, Tennessee.  The said Thelma M. Dunn having since died on or about June 24, 2012 leaving James P. Dunn, Jr. As the surviving tenant until his death on or about January 18, 2024 when he left two heirs:  James Dunn III and Jennifer Dunn.

This is improved property known as 18 Bomar Cove, Munford, TN 38058.

The sale of the subject property is without warranty of any kind, and is further subject to the right of any tenant(s) or other parties or entities in possession of the property. Any representation concerning any aspect of the subject property by a third party is not the representation/responsibility of trustee(s)/ Substitute Trustee(s) or their office.

This sale is subject to any unpaid taxes, if any, any prior liens or encumbrances leases, easements and all other matters which take priority over the deed of trust under which this foreclosure sale is conducted, including but not limited to the priority of any fixture filing. If the U.S. Department of the Treasury/ Internal Revenue Service, the State of Tennessee Department of Revenue, or the State of Tennessee Department of Labor and work force development are listed as interested parties in the advertisement, then the notice of this foreclosure is being given to them, and the sale will be subject to all applicable governmental entities right to redeem the property, all as required by 26 u.S.C. 7425, T.C.A. 67-1-1433, and 28 u.S.C. 2410 (C). The notice requirements of t.C.A. 35-5-101 Et Seq. have been met.

The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above. The trustee/substitute trustee reserves the right to rescind the sale

If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified/bank check made payable to or endorsed to Law Office of J. Phillip Jones.  No personal checks will be accepted.  To this end, you must bring sufficient funds to outbid the lender and any other bidders.  Insufficient funds will not be accepted.  Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.
