NOTICE OF SUBSTITUTE TRUSTEE’S SALE

NOTI CE OF SUBSTITUTE TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust dated February 27, 2021, executed by MARK T. BEAL and TERESA BEAL conveying certain real property therein described to GLENN BALLETTO, as Trustee, as same appears of record in the Register’s Office of Tipton County, Tennessee recorded December 20, 2021, in Deed Book 1938, Page 649; and

WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to Lakeview Loan Servicing, LLC who is now the owner of said debt; and

WHEREAS, the undersigned, Rubin Lublin TN, PLLC, having been appointed as Substitute Trustee by instrument to be filed for record in the Register’s Office of Tipton County, Tennessee.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable, and that the undersigned, Rubin Lublin TN, PLLC, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty, and authority vested and imposed upon said Substitute Trustee will, on June 17, 2025 at 11:00 AM at the North Door of the Tipton County Courthouse, 100 Court Square, Covington, TN, 38019, proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Tipton County, Tennessee, to wit:

A 1.22-Acre tract lying on the West side of Ray Bluff Road being part of Paul Wortham, Jr. 271,15 Acres, being the former Clyde Hill Homestead and Dower Tracts and being the Roy Arthur Whitehead Property as recorded in Deed Book 745, Page 134, in the Register’s Office of Tipton County, Tennessee being situated in the 5th Civil District and being more particularly described as follows:

Marshall Cove being the Southeast Corner of Roy Arthur Whitehead, D.B. 745/134: Thence North 87 degrees 42′ West, along the centerline of Marshall Cove, a distance of 270.17 feet to a set nail with washer being the southeast corner of a 2 acre tract in the name of Donald Van Pelt, D.B. 457/382, also being the southwest corner of this tract; thence north 02 degrees 18′ east, along the east line of said 2 acre tract, a distance of 207.08 feet to the northeast corner of said 2 acre tract, being in the south line of Jamie Sue Roberts, D.B. 522/335, also being the northwest corner of this tract; thence north 89 degrees 18′ east, along the south line of Roberts, a distance of 199.50 feet to a found spindle with washer in the centerline of Ray Bluff Road, being the southeast corner of Roberts, also being the northeast corner of Whitehead; thence south 28 degrees 48′ east, along the centerline of Ray Bluff Road, a distance of 130.31 feet to an angle point; thence continuing along the centerline of ray bluff road, south 00 degree deg. 20′ west, a distance of 106.00 feet to the point of beginning and containing 1.22 acres, more or less. Being the same property conveyed to Teresa Beal and Mark T. Beal, wife and husband, as tenants by the entirety by deed from Teresa Beal, formerly known as Teresa Phillips, a married woman, dated April 3, 2014 and recorded April 15, 2014 in Book 1620, Page 885, Register’s Office for Tipton County, Tennessee.

Property Address: The street address of the property is believed to be 3177 Ray Bluff Rd, Millington, TN 38053. In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control.

CURRENT OWNER(S): Mark T. Beal, Teresa Beal

OTHER INTERESTED PARTIES:

The sale of the above-described property shall be subject to all matters shown on any recorded plat; any unpaid taxes; any restrictive covenants, easements, or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. This property is being sold with the express reservation that it is subject to confirmation by the lender or Substitute Trustee. This sale may be rescinded at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The Property is sold as is, where is, without representations or warranties of any kind, including fitness for a particular use or purpose.
