NOTICE OF FORECLOSURE SALE

STATE OF TENNESSEE, TIPTON COUNTY

WHEREAS, Bobby R. Tittle executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc. As Beneficiary, As Nominee For Mortgage Investors Group, Lender and Charles E. Tonkin, II, Trustee(s), which was dated April 30, 2010, and recorded on May 3, 2010 in Book 1474, Page 924, Instrument Number 137517 in Tipton County, Tennessee Register of Deeds.

WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Tennessee Housing Development Agency, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on February 5, 2020, at 12:00PM at the usual and customary location at the Tipton County Courthouse, Covington, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Tipton County, Tennessee, to wit:

Lot 5, Florence Wooten Subdivision as recorded in Plat Cabinet A, Page 65 in the Register’s Office of Tipton County, Tennessee being situated in the City of Munford, Tennessee and being more particularly described as follows:

Beginning at the intersection of the west ROW line of Allen Street (50 foot wide ROW) with the south ROW line of Allen Cove (50 foot wide ROW) being the northeast corner of Lot 5, Florence Wooten S/D, Plat Cabinet A Pg. 65; thence South 01 deg. 45’ East, along the west ROW line of Allen Street, a distance of 105.00 feet to a found rebar being the northeast corner of Lot 4, also being the southeast corner of Lot 5; thence South 90 deg. 00’ West, along the line dividing Lot 4 and Lot 5, a distance of 170.00 feet to the northwest corner of Lot 4, and being the southwest corner of Lot 5, also being the east line of Lot 7, The Pines S/D, Plat Cab. A Slide 154-B; thence North 01 deg. 45’ West, along the west line Lot 5, a distance of 105.00 feet to the northwest corner of Lot 5, and being the northeast corner of Lot 7, The Pines S/D, also being in the south ROW line of Allen Cove; thence North 90 deg. 00’ East, along the south ROW line of Allen Cove, being the north line of Lot 5, a distance of 170.00 feet to the point of beginning and containing 0.41 Acres, more or less.

There are fences and utility poles and overhead utility lines located as shown on plat of survey.

Subdivision restrictions as recorded and building lines and easements as recorded at Plat Cabinet A, Slide 65 of the said Register’s Office.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.

This office is attempting to collect a debt.  Any information obtained will be used for that purpose.
