NOTICE OF FORECLOSURE SALE

STATE OF TENNESSEE, TIPTON COUNTY

WHEREAS, Michael S. Harkness and Alicia A. Harkness executed a Deed of Trust to Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Village Capital & Investment, LLC, its successors and assigns, Lender and Netco, Inc, Trustee(s), which was dated November 20, 2014, and recorded on November 26, 2014 in Book 1640, Page 456, Instrument Number 181654, subsequently modified by a Loan Modification Agreement recorded June 15, 2017 in Book 1725, Page 216, in Tipton County, Tennessee Register of Deeds.

WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Village Capital & Investment, LLC, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on January 14, 2020, at 12:00PM at the usual and customary location at the Tipton County Courthouse, Covington, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Tipton County, Tennessee, to wit:

Lot 7, Oak Creek Subdivision, Phase 1, as shown on plat of record in Plat Cabinet H, Slide 463, in the Register’s Office of Tipton County, Tennessee, to which plat reference is hereby made for a more particular description of said property.

This conveyance is made subject to subdivision restrictions, building lines and easements of record at Plat Cabinet H, Slide 463; Easement(s) of record in Book 1349, Page 799; Agreement of record in Book 1248, Page 883 as amended in Book 1248, Page 890; and Protective Covenants of record in Book 1345, Page 450, in the aforesaid Register’s Office.

Being the same property or a portion of the same property conveyed to Michael S. Harkness and wife, Alicia A. Harkness by Instrument dated July 31, 2013 from Barbara A. Hale, a married person filed on August 02, 2013 as Document Number and in Book 1598; at Page 1018; in the Tipton County records.

ONE BANK (USA), N.A.; LVNV Funding, LLC;
Midland Funding, LLC as successor in interest to Credit One Bank, N.A.; Midland Funding, LLC, as successor in interest to OneMain; Republic
Finance; and SECRETARY OF HOUSING AND URBAN DEVELOPMENT.

The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and

All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.  The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.

This office is attempting to collect a debt.  Any information obtained will be used for that purpose.
