NOTICE OF SALE

In accordance with the Order Of Reference For Sale Of Real Property For Partition of the Chancery Court of Tipton County, Tennessee made and entered in the above styled cause on September 12, 2019, public notice is hereby given that I will on:

FRIDAY, NOVEMBER 15, 2019 At the hour of 10:00 a.m.

In the Chancery Court Courtroom at the Tipton County Justice Center in Covington, Tennessee, sell to the highest and best bidder, the following described tract of land, to wit:

Parcel No. 1:

Beginning at a stake in A. S. Witherington’s west line Arthur Albritton’s southeast corner; thence south 86 ¾ degrees west 26.00 chains to a stake Arthur Albritton’s southwest corner; thence south 9 degrees west 9.50 chains to a stake in Blackwell’s east line; thence north 86 ¾ degrees east 24.84 chains to a stake; thence south 3 ¾ degrees east 9.50 chains to a stake; thence south 84 degrees east 3.16 chains to a stake in Witherington’s west line; thence north 3 ¾ degrees west 18.75 chains to the beginning, containing 28.14 acres.

The above parcel being the same conveyed to Sam Albritton, also known as Willie Ernor Albritton, by Arthur Albritton, et al., by deed of record in Deed Book 207, page 87, of the Register’s Office of Tipton County, Tennessee.

Also being Map 107, Parcel 007.01 according to the Tax Assessor’s Office of Tipton County, Tennessee

Parcel No. 2:

Being a part of the 71 1/5 acres purchased by Clarence Faulk from J.C. Faulk by deed at Book 79, page 37, of the Register’s Office of said County and beginning at the northeast corner of the same, a stake with white oak pointers (now gone), it being also C.C. Crenshaw’s northwest corner; thence south 19.10 chains to a stake in the field; thence west 18.36 chains to a stake in the south boundary line of said 71 1/5 acre tract; thence north 19.10 chains to a stake in the Mason and Randolph Road; thence east with said road 18.36 chains to the beginning, containing 35.07 acres, more or less.

The above parcel being the same conveyed to Sam Albritton, also known as Willie Ernor Albritton, and wife, LaVerne Albritton, by Charlie Malone and wife, Millie Malone, by deed of record in Deed Book 181, page 59, in said Register’s Office.

BUT THERE IS EXCEPTED out of the abovesaid Parcel No. 2 the following described lot conveyed by said Willie Albritton and wife, Mary Albritton, to Edward Terry and his wife, Katherine Albritton, by deed of record in Deed Book 277, page 403, in the said Register’s Office:

Beginning a stake in the north line of the old Mason-Brighton blacktop road, at the southeast corner of the Sam Blackwell tract and the southwest corner of the 35 acre tract of which this is a part; thence north with the east line of the Blackwell tract 210 feet to a stake in same; thence east and parallel with the north line of the Mason-Brighton blacktop road 210 feet to a stake; thence south and parallel with the east line of Blackwell tract 210 feet to a stake in the north line of the blacktop road; thence west with the north line of the Mason-Brighton blacktop road 210 feet to the point of beginning, containing one acre, more or less, and being a lot of land out of the southwest corner of the tract conveyed to said Willie Albritton and wife, Mary Albritton, by Charlie Malone and wife, Millie Malone.

The said Sam Albritton, also known as Willie Ernor Albritton, died intestate leaving his wife, Mary Albritton, his son, I.B. Albritton, his grandson, James Edward Albritton, and his adopted son, Dondi Ortiz Albritton, as his next of kin and only heirs at law.

The said LaVerne Albritton predeceased the said Sam Albritton, and the said Sam Albritton was later married to the said Mary Albritton.

Also being Map 107, Parcel 031.00 according to the Tax Assessor’s Office of Tipton County, Tennessee.

See also deed recorded at Book 367, page 138, in the Register’s Office of Tipton County, Tennessee.

The sale of property is subject to a leasehold interest held by Larry Rice.

The property will be sold for cash, in bar of the equity of redemption and all exemptions.

The Special Commissioner’s Report of Sale will lie upon her desk for a period of ten (10) days following the sale, subject to being raised and reopened by deposit of advance bid of at least 10% over the initial bid price.  The property will be sold as is, where is, with possession given upon confirmation of the sale.
